They throw DMCA's at children hospitals on 20+ year old hardware and shut down anything that even looks like it uses sound bytes from Mario games on jewtube.

Well for starters C&D letters are not legally binding and only retards listen to them. Secondly DMCA takedown notices, while sorta legally binding, can be filed by anybody, not legal representatives of a company.

A DMCA request has to be made for the threat to exist. There was no takedown notice since the game wasn't released yet.

No, if it did that shit it'd enter fanfic territory. You can't just have a cameo from Porky or Giygas for no reason, even if it fits the story. Not even the MOTHER games did that. If something appeared in multiple games, it had legitimate reason. Mother 4 wasn't intended to be a follow-up to any of the MOTHER games, in fact it's set before MOTHER 1 even happened. So it'd make next to no sense to put in more than a Mr. Saturn anyway.
