I've looked farther into it and from 21 CFR 1271.420 (hehehe) it appears that the loophole is that if you claim that your sperm donor (or egg donor) is an intimate partner then you do not have to go through all the regulations of the FDA. pic 1 shows the loophole in 1271.420(c). link:

anyways, on my computer now, and I did some more digging. From article [43] (link below) I found mention of the California Cryobank which led to me searching through their donors online, along with other sperm bank donors that let me search. anyways, pic 1 is an interesting excerpt that seems to convince that the California Cryobank was confused by the banning too. they probably wanted that money for the Nordic sperm they were used to as well.
