I don't think "punishment" should be part of the legal system. This is a puritanical idea of criminal justice. Instead, we should be utilitarian. If someone cannot be rehabilitated into society, then they should be removed from it, but that is about it. The idea that you have to suffer for your crime is something which comes from religion and desire for revenge rather than utility and materialism.

You see, I have this feeling that any legal system we build will be fallible, and will therefore lead to innocent people being put in situations that they should not be. The problem is the second part of that sentence. All punishments are far too harsh in our current society. The idea that crime is caused by a lack of punishment is one of the most harmful and counterproductive spooks our civilization has ever invented.

The only two goals of the justice system should be altering the material conditions of society to make crime unnecessary, and rehabilitating offenders in such a way as to minimize suffering for all parties.

I suspect the overwhelming majority of sex-related crimes can be prevented just by giving our society a more healthy view of sex. With the amount of repression, fear, misinformation, hatred and mindless panic surrounding discussion of sex it's amazing that we have as few sexual assaults as we do. Once people recognize that sex is really not a big deal and there's nothing wrong with a bit of masturbation or prostitution, rapes will be far less common.

In this specific case I'd literally just give him some mandatory counseling and send him on his way. The social stigma of being a rapist is already going to prevent him from ever forgetting his mistakes.

Prosecutors are very picky with rape cases though. An investigation will ensue, of course, but unless someone is incapacitated they aren't going to bring charges cause it will just get overturned on appeal.

No, there's nothing really inherent to rape as an assault that justifies it's special status in society and the legal system.

It carries extra weight for a couple of reasons, IMO.

1. It is popularly perceived as something that can only legitimately happen to women and any assault on a woman by a man is automatically treated as greater outrage because of the way our society regards the sexes.

2. There is some holdover from bygone days that sex destroys a woman's purity. So rape as an assault is not only the physical attack, but also does irreparable damage to her social status and prospects for finding a mate. ie. it really could destroy her life.

Number 2 doesn't have a great deal of basis in reality any longer, but I suspect that it not only still informs the extra gravity that it carries as a crime but also the whole industry that surrounds it that makes it profitable to convince victims that they are damaged forever (and therefore justify both public and private funding in perpetuity for the support industry) rather than as something they'll get over with time as it is with most other assaults.
