You need to decrypt it or at least know what's in there. If LE sends you a message "hey user, file #235576 is CP, here's the key", then you're liable, but if they just have a bunch of keys they can't go around busting down people's doors willy-nilly.
You need to have decrypted it, or someone else needs to have decrypted it and told you about that specific file.

The IPFS blacklists are ONLY for the public-facing gateways. The regular nodes don't even see them, I think you have to send them an email if you want them so you can't use them as a "download everything in this list" source.

There is work being done to make go-ipfs modular, pluggable, and interoperable with other systems. For example you could swap the native routing for i2p, the encryption for something else, interoperate with freenet peers, etc. IPFS isn't going to compete with other protocols and systems, since that doesn't work and is terrible for adoption. Instead they're trying to just layer overtop of them. This is great for migration since all the same content is accessible from both systems, and good for the life of the project itself since it won't stagnate and/or break compatibility suddenly.

I'm pretty excited about this since it just sounds like a modern redesign on other critical internet technologies.
