I'm a lawyer working in the bowels of Washington, D.C. – or "legalfag" as you would rightly call me. I lurk and post on halfchan and fullchan. Regardless, the purpose of this post is to discuss the legal implications of a purported imposition of martial law by the President of the United States. Therefore, I will outline what the President's legal team may do to craft a document impose martial law. The outline will focus on the basic legal premise of martial law and expand the argument with precedent. Ultimately, I will offer several conclusions.
Pardon in advance for any spelling or grammatical errors since I write this post with brevity at work.
I. CONSTITUTIONAL ISSUES REGARDING MARTIAL LAW
The Constitution allows the federal government to suspend the privilege of the writ of habeas corpus if the public safety requires it. If Pres. Obama wished to issue a suspension of habeas corpus, his legal team would craft a document imposing martial law based on the thesis implied by U.S. Const. art. III, § 9, specifically regarding the writ of habeas corpus and the requirement for suspension thereof. The President's legal team must then fuse the aforementioned Section (§) with U.S. Const. art. I, § 8 regarding activation of the militia in time of rebellion or invasion.
A good legal team will rightly see that the federal government has the ability to impose martial, but the Constitution does not delineate if the President or U.S. Congress can impose martial law. There is one outstanding federal case that makes it fairly difficult for the direct imposition of martial law directly by a sitting President. That is of Pres. Lincoln during the Civil War.
II. PRES. LINCOLN'S LEGAL PRECEDENT
The internet is abound with Pres. Lincoln's suspension of habeas corpus during the Civil War as a basis for an Obama-imposed martial law. Legally, an opponent could easily strike down such a direct imposition by a sitting President by citing standing precedent ruling Pres. Lincoln's suspension of habeas corpus during the Civil War as unconstitutional in Ex parte Milligan, 71 U.S. (4 Wall.) 2 (1866). The ruling in ex parte Milligan provides sufficient legal cover to declare any suspension of writ of habeas corpus as unconstitutional if military courts administer the law when there are civilian courts (civilian authority) is still operational.
1) President Obama would have to suspend all civilian authority regarding all courts in the United States for a "true" version of martial law. This would only occur if there was a direct attack on the United States by a foreign invader and every civilian court had to cease duties. This leaves sufficient wiggle-room for people to speculate the definition of an "attack" and what defines the imposition of "ceasing the operation of civilian courts.''' This in itself is a tract of legal precedent, interpretation and wrangling which would likely have Obama's legal team seeking a sustainable amount of legal footing to make such a legal argument constitutional.
If Pres. Obama would go this route, he would likely have a favorable legal interpretation presented as the basis for his argument and then impose martial law without seeking approval from the U.S. Congress. This would immediately be challenged on constitutionality and likely be ruled as unconstitutional by any court based on Milligan. However, legal challenges take time, so even if the act is unconstitutional, it would likely take a long time for the case to go through all appellate courts to the Supreme Court. During the time it takes for the imposition of martial law to be overturned, martial law would likely be imposed unconstitutionally.
The fail-safe in this case is the Armed Forces. If the generals refuse to take an "illegal order" from the President, meaning the military would wait for a court ruling until it complies with the President's order for martial law. This would create a stalemate between the military and a civilian President.
2) The President's legislative team could draft martial law legislation and have the House and Senate approve it. This would be a constitutionally congruent imposition of U.S. martial law,' since representatives of "the governed" sufficiently reviewed and voted on behalf of their constituents' interests for martial law. Thus, the court would view that U.S. citizens were "involved" in the imposition of martial law on themselves.
The aforementioned is the strongest legal argument, since legislation approving martial is passed by the legislative branch and approved by the administrative branch of government. The Supreme Court would likely not overturn this approved legislation (standing law, U.S.C.) unless there are technicalities regarding the legislation and approval thereof that would make the martial law unconstitutional.
In this case, the military would be utilized to impose martial law. The military, however, may refuse to impose martial law because the military simply doesn't believe martial law is a reasonable solution. Legally, the military would be criminal in its failure to indulge the Congress and President on any newly passed and approved statute regarding martial law. This is essentially the generals saying "fuck you" to both the President and U.S. Congress.
The military could be circumvented by ordering the police and other forms of armed law enforcement not under the jurisdiction of the Department of Defense to impose martial law. This could range from local police to DHS imposing martial law. The military would either stand down and do nothing, or engage in what would essentially be civil war. If this was the case, the President ask for international military intervention. If the U.S. military wished, it could easily remove the President, Congress and expel foreign nationals intervening on behalf of the President's imposition of martial law.
3) International law/Treaties. I don't know enough about this part of the law, but there may be a U.N. treaty where there could be interference based on some delineated clause in said treaty. I doubt this exists and if it does, it would immediately be taken to court and likely be ruled as unconstitutional because U.S. Congress likely did not pass the law explicitly regarding the suspension of writ of habeas corpus.
As explained above in Section 2, the President could ask for foreign military intervention and "assistance" in maintaining martial law. This would likely be ruled unconstitutional.

CONCLUSION
Challenging a law or an act of the President takes time. It could take months or even years (if not fast-tracked) for the lawsuit to go through the entire appellate process and be heard by the Supreme Court. This window of time gives proponents of martial law the ability to engage in whatever activities they have planned.
In my opinion, the people who have final say are the people of the U.S. Armed Forces. Do the generals in the military have the balls to stand up to any form of martial and protect the populace from the imposition of martial law? If yes, then we're okay. If no, hopefully the lower ranks of the military will have cooler heads and protect the people from martial law.
Martial law has never really been fully analyzed except by several legal scholars. The issue is that nothing is truly set in stone. States have imposed martial law, but an apt legal team could argue and help overturn such rulings.

In case anyone else is lurking this thread and haven't seen what I've seen on civil war matters, let me state plainly: we would fucking win a civil war, and easily.
This subject is grossly complex and there is a lot to say about it, but I'm going to attempt to tl;dr the strong points for everyone.
1) The government requires ridiculous amounts of infrastructure in order to fight against the people/freedom fighters. They have military operations and communications that require a ton of logistical maintenance and support in order to correctly operate. Disrupting any of this would be easy to do and devastating. 2) A civil war means Obongo/the feds would have zero idea where anyone's allegiances lie. Remember that only 6% of Americans trust the media, and Obambu's support/popularity is at an atrociously low level. Civil war is guaranteed to produce many large chunks of the military that take our side, including plenty of high ranking military brass. This brings us directly back to no. 1 above. 3) Going along with 1 and 2, there will be some in the intelligence community who side with us. All we need are around 10% of their employees to side with us, and intelligence can be easily and utterly subverted or outright wrecked. Worse, the feds will have no idea who is actually a mole fighting for us and who isn't, and finding out is a large drain of resources and will hardly set us back. Disrupting communications and intelligence is a huge hit against the government. 4) Going off of 3, we, the freedom fighters, do not require the kinds of logistical and intelligence support the government does. As proven by this board alone, we are all trained to think and operate independently with no requirement for support, as we hold true to a certain set of values and understand what needs to be done. We are decentralized and have no leader or command structure, and we can operate in fragmented cells and amorphous blobs that can break and reform as needed. Fighter cells can disable electric grids or communications easily if they know where to look or go, and what to do, much like someone sitting on the ground kicking out a stool from under someone standing on it.
There are many more things to mention and exactly what those are and how all these things intertwine is both complicated and incredibly fascinating, so I suggest you faggots start searching and reading.

Assuming that ALL of the military sides with him, they still need to keep all of their infrastucture and logistics that support their massive military machine from collapsing due to sabotage from their own citizens. Even then, freedom fighters are everyday people with no real command structure and no uniform. They do what they want, when they want, and lack of identifying clothing makes it easy for them to hide among the "innocent bystander" population. Fighting against troops gives the fighters the advantage; they may have superior technology and firepower, but they're bogged down by command structure and logistics, and are easily identified. The troops will also be outnumbered: The most they could muster is 2.4 million people. That's EVERYONE in the military. Top brass, bottom brass, reserve military, EVERYONE. Including the president himself, 2.4 million people.
Our population is 320 million. Less than one fucking percent of our population would outnumber the whole of the military. Keep in mind that for successful revolution, the general benchmark is having 10% of your population on your side and actively involved in order to be guaranteed success.
Long story short A civil war would be a fucking nightmare for the establishment even if every single gun they had was loyal, and victory for them would be slim and also extremely Pyrrhic. Do note that they most certainly will NOT have a lot of the military on their side. I'd be shocked if they managed to even grab 60 percent, and that's being generous.

The truth of the matter is martial law has never ended and The District of Columbia Organic Act of 1871 established the UNITED STATES foreign Corporation. The Corporation only acts under the Constitution OF the United States and not the original Constitution FOR the United States

1st: Martial Law is declared by President Lincoln on April 24th, 1863, with General Orders No. 100; under martial law authority, Congress and President Lincoln institute continuous martial law by ordering the states to either conscribe troops and or provide money in support of the North or be recognized as enemies of the nation; this martial law Act of Congress is still in effect today. This martial law authority gives the President (with or without Congress) the dictatorial authority to do anything that can be done by government in accord with the Constitution of the United States of America. This conscription act remains in effect to this very day and is the foundation of “Presidential Executive Orders” authority; it was magnified in 1917 with The Trading with the Enemy Act (Public Law 65-91, 65th Congress, Session I, Chapters 105, 106, October 6, 1917). and again in 1933 with the Emergency War Powers Act, which is ratified and enhanced almost every year to this date by Congress. Today, these Acts address the people of the United States themselves as their enemy. 2nd: The District of Columbia Organic Act of 1871 created a private corporation (hereinafter “Corp. U.S.”, Trademark name, “United States Government”) owned and operated by the actual government for the purpose of carrying out the business needs of the government under martial law. This was done under the constitutional authority for Congress to pass any law within the ten mile square of Washington, District of Columbia (link to PDF image file of the full 1871 Act).

3rd: In said Act, Corp. U.S. adopted their own constitution (United States Constitution), which was identical to the national Constitution (Constitution of the United States of America) except that it was missing the national constitution’s 13th Amendment and the national constitution’s 14th, 15th and 16th amendments are respectively numbered 13th, 14th and 15th amendments in the Corp. U.S. Constitution. At this point take special notice and remember this Corp. U.S. method of adopting their own Constitution, they will add to it in the same manner in 1913.
4th: Corp. U.S. began to generate debts via bonds etc., which came due in 1912; but, they could not pay their debts; so, the 7 families that bought up the bonds demanded payment and Corp. U.S. could not pay. Said families settled the debt for the payments of all of Corp. U.S.’ assets and for all of the assets of the Treasury of the United States of America.
5th: As 1913 began, Corp. U.S. had no funds to carry out the necessary business needs of the government; so, they went to said families and asked if they could borrow some money. The families said, “No.” (Corp. U.S. had already demonstrated that they would not repay their debts in full). The families had foreseen this situation; and, had the year before finalized the creation of a private corporation of the name “Federal Reserve Bank”. Corp. U.S. formed a relationship with the Federal Reserve Bank; whereby, they could transact their business via note rather than with money. Notice that this relationship was one made between two private corporations and did not involve government (see: The Clearfield Doctrine); that is where most people error in understanding the Federal Reserve Bank system—again, except by contract with Corp. U.S., it has no government relation at all. The private contracts that set the whole system up even recognize that; if anything therein proposed is found illegal or impossible to perform it is excluded from the agreements and the remaining elements remain in full force and effect.
6th: Almost simultaneously with the last fact (also in 1913), Corp. U.S. adopts (as if ratified) their own 16th amendment. Tax protesters challenge the IRS tax collection system based on this fact; however, when we remember that Corp. U.S. originally created their constitution by simply drafting it and adopting it, there is no difference between that adoption and this—such is the nature of corporate enactments. You must also note that this amendment has nothing to do with our nation, with our people or with our national Constitution; which already had its own 16th amendment. The Supreme Court ruled that it did nothing that was not already done other than to make plain and clear the right of the United States (Corp. U.S.) to tax corporations. We agree; considering that the IRS was created under the authority of Corp. U.S.
7th: Next (also 1913) Corp. U.S., through Congress, adopts (as if ratified) its 17th amendment. This amendment is not only not ratified, it is not constitutional; the nation’s Constitution forbids Congress from even discussing the matter of where Senators are elected: which is the subject matter of this amendment. According to the United States Supreme Court, for Congress to propose such an amendment they would first have to pass an amendment that gave them the authority to discuss the matter.
8th: Accordingly, in 1914, the Freshman class and all Senators that successfully ran for reelection in 1913 by popular vote were seated in Corp. U.S. Senate capacity only; respectively, the original jurisdiction Senate seats from their respective States remained vacant; because, neither the State Senates nor the State Governors appointed new original jurisdiction Senators to replace them; which is still required by the national Constitution for placement of a national government Senator.

10th: In 1918, President Wilson is reelected by the Electoral College; but, Electoral College elections are required to be confirmed by the constitutionally set Congress; and,where the new Corp. U.S. only Senators were allowed to participate in the Electoral College vote confirmation, the only authority that could possibly have been used for electoral confirmation was limited to corporate only. Therefore, President Wilson was not confirmed into office for his second term as the President of the United States of America; rather, he was only seated in the Corp. U.S. Presidential capacity as the President of the United States. Therefore the original jurisdiction government’s seats were vacated because the people didn’t seat any original jurisdiction government officers. It is important to note here that President Wilson retained his capacity as Commander in Chief of the military. A) You are propagating a myth. Your post is disinformation. I will discuss it in Sec. B:
B) Why the United States is not a corporation
1) There are governmental corporations – I believe there are 22. These corporations were incorporated by the federal government for various reasons. One such corporation is the Tennessee Valley Authority, or "TVA."
2) The legal argument in your copypasta is false, since the U.S. as a nation is codified as a sovereign nation in U.S. Const. This legal document enables the U.S. to operate as a sovereign nation among other sovereign nations. Other sovereign nations have different forms of governance, law and legal procedure per aforementioned non-U.S. sovereign nations' law.
3) The federal government can create corporations, but legal jurisdiction over U.S. citizens are derived from the U.S. Const. The U.S. Const. delineates U.S. national sovereignty. Only a sovereign nation can enforce criminal law upon its citizens.
Since a corporation is a creation of civil law and not a creation directly derived off a legal argument based off U.S. Const. and criminally enforceable U.S.C., which define the sovereign state of the United States. Criminal law supersedes civil law in legal "privilege." The U.S. defined by U.S. Const. as a sovereign state can create a corporation that is a creation of civil law, that corporation can not legally impose criminal law in the same manner as that of a sovereign state (the U.S.). The law cited in your post was struck down in 1874. Washington, D.C. was handed civilian authority in the 1960's. Also, the State of Virginia took back its portion of Washington, D.C. (Alexandria and Arlington counties). Washington, D.C. is not under what is defined as martial law because that implies military courts enforce the law rather than civilian courts.
Legally, the whole "God" argument is "technically" true. The U.S. Const. is meant to protect the rights of humans which are already "God-given." The U.S. Const. does not grant rights but "protects" the rights given to us by "God."
In reality, the rights of people in any nation are not given to them by any 'God' but by the government (people) which has a monopoly of violence over its population. The monopoly of violence thus gives a nation its ability to enforce laws under the sovereign country's jurisdiction. Thus, rights are "granted" by the people who control the monopoly on violence, such as law enforcement and the military.

If you want to work with highly functional psychopaths and sociopaths. You get paid a shitload of money, though. The hours suck. At least you don't see said psychopaths all the time, since essentially you lock yourself in your office.
The big firms hire from top-tier schools, like the Ivy League, NYU, etc. In my personal opinion, we have a tendency to pre-screen Asians and kikes since they always get high scores but suck when practicing law. We figure this is because many are forced by their parents to do something they don't really love. The best lawyers end up being ones who really enjoy practicing the law. Usually, we work the fuck out of associates to separate the wheat from the chaff.
For example, one of the greatest trial lawyers is Gerry Spence, who went to a shit-tier school in Wyoming, but he was talented because he could bullshit a jury.
Also, in law school you're going up against sociopathic and psychopathic students who will do anything to undermine you. Always watch your back, and the shit you learn in law school will rarely be used in real life. It's fucked up, actually.
There are several distinct type of lawyers, the "hard-working" Asians who usually suck in litigation but are awesome research robots. Then you have the "rainmakers" whose job is to simply bring in business by courting and connecting people to gain clients. These fuckers get paid millions of dollars. Then you have the trial team: extremely at the art of rhetoric, they have the presence and oratory skills that can convince a sandnigger in Iraq to buy sand at $1,000/lb. I hate kikes because they're their own little "group" in the firm and get ahead through nepotism. Finally, the partners are the big-shots and everyone guns to become a partner, since you're essentially secured wealth and status – at least at the firm I work for.
TL;DR
The people who can attain the monopoly on violence create the law. Whoever has the better trained people, more power and the most firepower will attain the monopoly on violence. Usually this is the military. All laws are derived from the monopoly on violence. This "monopoly" creates the stability for a functional and eventually legal government.
Those with the guns and training to beat the other side get to create law.

Yes, and don't forget nativist LatAm powers. Most Holla Forumsack don't seem to be aware of the mini cold war going on right now over South America. Chile, Peru and Colombia are firmly in the US camp, while Bolivia, Argentina, Brazil and Venezuela form a more or less aligned nativist/regionalist coalition.
