Depends. There's three answers.

If we're answering on a purely ideological standpoint, Cap. The ideal of voluntary heroics is a defense against individual accountability and is basically a "the individual contributes to the society", while Iron Man's stance is a top down approach that the state must control the accountability of the individual. Everything should be down to top. Individual, family, clan, nation. All important, but it starts at the individual.

However, if we take the characters themselves into account, as far as the comics go, (and the comics did a shit job at this), Iron Man is right because of later events. While yes he did take a top down approach, he is essentially a benevolent dictator and leader. He'd never betray the other heroes or their identities to a globalist or shady ZOG organization, and indeed he kept the only copy of the registry in his own Extremis modified head, and deleted everything at the cost of going into a coma once shit hit the fan during Siege.

On the flipside, in the movies, Cap is once again right. He stands by his friend, his kin, while Iron Man sides against. And in the movies it's more clear cut that Cap is right to stand up (wasn't as clear in the comics because MUH DIFFERENT SHADES OF GREY! NO HEROES).

Plus Iron Man himself goes rogue and the end becomes a personal struggle over what Bucky had done spoilers, he killed Tony's parents
