Writing that kind of character takes a little more talent than most comic book writers have so instead hes just a dumb clown who comes back again and again like the villain in a slasher flic franchise.

They tried to execute him for one particular murder that he got framed for. Batman stopped it because it was a sham of a trial and a mockery if the Justice system that he got charged and rushed toward death with basically no evidence.

In my opinion, Batman was entirely in the right for stopping that whole mess, but the story fell apart when he didn't present them with the piles of proof to his guilt of other murders so they could have a legitimate open-and-shut case to execute him with.

It's one of the big plot holes in Batman. The supervillains in that series are so destructive that they definitely would have reinstated the death penalty by now. Perhaps Bruce Wayne owns all the politicians and lobbies against the death penalty, because he's a massive fucking liberal or he likes to play dress up or something.

If you ask me, I don't think Batman should have stopped it. Yeah, it's less than ideal for Joker to finally go down for the one thing he didn't do. But considering that there's absolutely no question he killed countless other people, and will kill again, if a frame job's the only way to put him out of the picture for good, so be it. Even if he doesn't deserve it for that particular crime, he still deserves it a thousand times over for others.

And regardless of deserving, I'm sure that if Joker's future victims are given the choice between being killed by him, or Joker never killing them because he got executed first, they'd choose Joker getting the chair. That to me is the biggest reason to kill the Joker. It's not to punish him for those he killed, it's to stop him from killing again.

This is the Gordons' view in the story. Gordon thinks he should die anyway because of what he's done to others and what he did to Barbara. Batman disagrees. Batman clears Joker anyway. The Gordons get pissed off at Batman.

Assuming that Joker will kill again isn't some iffy, maybe self-fulfilling prophecy deal when he's escaped and killed again so many times already. It's about as controversial as assuming that the next time you drop something, it'll fall.

Using actual past actions as a predictor of future actions is how we make sense of the world, and unless you go around jumping off the roof until you finally fly, you do too. I see no problem with applying the same logic to Joker.

Originally the writers never had to consider giving him a death sentence because he was just a deranged petty criminal who focused on robbery.

Then DC decided to make him a murderous rapist for some reason, but never bothered to ask what would happen to real life criminals who did the things nuJoker did. So they kept the revolving door at Arkham formula going, but without the crucial element of Joker being a non-lethal felon who could believably be given sympathy by the system for his mental health issues.

As for The Joker's murders in Batman #1 (he killed 7 people, with the possibility of 11 if the shots he fired while escaping were fatal), he paid for those crimes in Detective Comics #64 "The Joker Walks the Last Mile". The state executed him, but he had his gang revive him, making him a free man. That story marked the culmination of the toning down of The Joker that started the minute editor Whitney Ellsworth saved him from death at the end of Batman #1.

Execution is a state by state thing. Some states are reluctant to execute, others will execute you as soon as they can. So blame whatever state Manson is serving his sentence in, not the entirety of the states.

The joker is far too popular to be killed off. If it was a lesser villain, he would have gotten the chair years ago.

The weeding out would be part of the setting's past, so a majority of the story would be about the antics of the goofy ones.

Either the goofy ones, the competent ones, or the competent goofy ones.

Could end up like Venture Bros; villains tends to get paired up with heroes who operate in a similar genre; the glorified pranksters get mildly beaten by weirdos in tights and sent to low security asylums, the edgelords end up dealing with Punisher-likes and thus have a low survival rate.

Villains stay goofy and stick to their rules and gimmicks because they're tolerated and not hunted, and heroes do something similar because otherwise they'd be considered the same thing.
