That we have read the recusal letter from the last DA and are aware of all of the evidence (including the fact that he was wearing boots and carrying a hammer right before his assault of the McMicaels). He is clearly the Primary Aggressor and was not "cordoned" or "blocked" from passing and therefore somehow forced to attack the McMichaels. He cannot claim Credible Fear due to his passing the truck and coming 180 degrees to attack Travis. He was legally armed with both the hammer and the shotgun (had both hands on it) and was therefore committing assault with a deadly weapon in the later case. It could be seen as a Consciousness of Guilt with him running away from the house he was seen in (probably stole the hammer from here) and running from the McMichaels. His assault could also be seen as Intimidation of a Witness in this case.
