Replace Roy Moore with Jimmy Saville and Gadsden Mall with some English hospital, and you should be able to see why the ambiguity of whether or not he was actually banned is not the central issue.

Also, I don't know why a mall would be obliged to keep an '80s ban list or why a cop would necessarily be able to confirm a ban list.

I can't really make this any clearer. See the Jimmy Savile comparison I made earlier - there were longstanding rumors (often censored) that Savile was abusing kids. Had some hospital staff member tried to give him the boot along the way, that would be noteworthy - but getting kicked out would be an effect of his behavior, not the behavior itself. Abusing kids is the behavior.

This article is about longstanding rumors that Roy Moore (who had already been publicly accused of sexual assault as of this article's publishing) had hung around this particular mall trying to pick up young and underage girls. A few of the people interviewed in the article also say that they remember hearing he was kicked out of stores in this mall, banned from the mall, or reported by some of the girls he was chasing. Again, here, if he was somehow punished at the time, this would be an effect of his behavior. And the behavior itself is more consistently confirmed by those interviewed.

The ban detail is notable, but it is not the underlying issue the article is addressing.

I think you misunderstand. It's still illegal to have sex with a minor they just dont charge it as rape if it's not rape it is a different charge. How their laws distinguish it is fine, otherwise you would have consensual sex with a minor and rape of a minor charged the same.
