The process in the game industry is a little different, and a little more blatant if you choose a song that already exists. This is especially true for earlier games where nobody would ever notice if you ripped off somone else's music and just used it in a way that works with your game.

I'd say "Heavily inspired". There's enough difference in the melody that it's not a straight up stolen track. Definitely stole the opening riff at least.
With the Payday one, considering the game was based almost completely off Heat, it makes sense to do an homage to one of the big heist themes from the movie.

That's kinda sad and feels lazy. When B.Poledouris composed the Robocop or Conan OSTs he focused on sensations and feelings and tried to craft something based on that. Even if you don't see the actual movie you can imagine the scene by hearing the music. You can see the same passion, emotion and technique in the work of many vidya composers.
When I make music, I always show it to people who have no clue. The result is magical: they often describe forests and rivers, or a grand journey, or something as specific as "a vampire in an abandoned castle with snow falling outside". If that happens, I consider the melody a success, so I fix the details and send it to my bosses.
I hope people pay attention to music again.
This is less of a crime. It's very easy to listen to a lot of music for inspiration and end up composing something you heard somewhere else. Sometimes it has happened to me that in the middle of making a song I felt "shit, this feels oddly familiar" and ended up redoing the whole thing because I was accidentally using something from an older, classic game. Pressure and a tight deadline will do that to you.
