It's an unenforceable law though, due to the ease with which software data can replicate and spread.
Even monitoring for it would require backdoors so large you could park your car in them, and DRM does nothing to deter piracy, and when you use DRM badly remember Spore? it actively encourages people to not buy it.

Also, there's a big hole in calling piracy theft since theft requires the original owner to be deprived of their possession, when even a 5-year-old can tell you that copying a thing leaves behind the original.
The proper term is "violation of copyright," and I don't think those laws have been seriously examined since making massive numbers of copies for distribution represented a significant investment.

I like this explanation, although it's a bit extreme to say that you just shouldn't pirate anything anyone's trying to make money off of. Piracy laws are really poorly enforced; there just aren't enough resources to catch a significant proportion of pirates out there, and torrents by their nature are difficult to track. And you can make it even safer with proxies and VPNs.

However, some of the theory on how to enforce a law sort of relies on the threat of punishment if caught.
If the law were truly easy to enforce, as a downloader, you would be probably hit up with something no bigger than a speeding-ticket's worth of fines and penalties. A misdemeanor more than anything else.
But since it is difficult, those that they DO catch are made examples of. The theory being that those examples can help deter people from doing it.

I remember someone who was forced to pay 80,000~ USD because they caught him with a pirated copy of that Ang Lee "The Hulk" movie. The one from the early 2000's that was really shitty and bombed at the box office.
It is shit like that which is why I say don't go after popular or current things if you're going to pirate at all.
Pirating Star Wars episode 7 might get you caught while pirating Dune certainly never will.

Also, violating copyright is becoming more and more of a pressing issue since we have long since moved over from a goods-producing economy into an information and services exchanging one. Question: How do you feel about the act of pirating a game for one platform when you already own it on another? For instance, I pirated Deus Ex Human Revolution on PC, but I own that shit on PS3. I already paid my due, and it's essentially the exact same experience. Sure, it may run at a higher frame rate, but I'll be fucked if I'm going to shell out money just for that. If I ever catch it during a sale, I might throw down some cash for it, but I hate the idea of paying for something more than once.

Nintendo, in an effort to stop the piracy in the form of emulated games started to re-publish their old games on virtual console, GBA, etc etc. Many other companies are doing the same.
However, because they often add some new features (HD graphics) or some other shit, you could possibly get away with the argument that the game you wanted was not being currently sold on the platform or in the state that you wanted it in. The Super Mario Bros. 3 game on GBA is far different than the one that was on NES, for example.

On a side/personal note: I think that given the current state of multi-platform design specification and publishing that you have every right to a game on a different platform so long as they're all sold as essentially the same on those platforms. In fact, I find it rather reprehensible that you can't just buy a game and have keys/licenses to put it on whatever platform it is available for.

The cost of pursuing pirates is almost never actually justified (if you don't consider the difficulty in measuring the values of the software being copied in the first place) so governments rarely do it.

The legal implications and justifications of piracy is heavily debated. I do not believe it is morally wrong to copy and paste a piece of software. and there are millions of people in fact who would agree with me

Piracy gives you an idea on how the game actually plays like, when publishers stopped putting out demo versions. So if you find the game fun, sooner or later you'll feel obliged to buy the game, maybe even premium edition. If you get bored with the game before buying it, it probably was not worth the price anyway.

Piracy also helps keeping the games available and untouched, when devs don't care about it anymore or care enough to retroactively censor the game or outright remove it because you can't be arsed to reacquire rights to the ingame music or vehicle model or something
