I used to think that Nintendo got really arrogant with the Wii U with its lack of advertising and everything but when I think about it more, it feels like Nintendo knew that it was going to fail before release after the lukewarm response the 3DS got from casuals, the lack of enthusiasm from 3rd parties and the rise of smartphones. The big wakeup call was probably the 3DS's lackluster launch. Nintendo probably got really worried when a DS superstar casual game like Nintendogs sold like shit on the 3DS as a launch title. Most of them don't use official sprites and tilesets and most Pokemon fan projects aren't fan games but fan romhacks, which are legally different.

They know that anyone who uses torrents is also savvy enough to use emulators instead of buying roms on the virtual console. When someone is offering a derivative of a company's work, they're usually served a Cease and Desist, with DMCA being reserved for websites hosting the actual original piece.
