9th November 2005 - Revealing highlights of transcript of 28th June Magistrates Court proceedings…

and, (6th December 2005), highlights of a previously missing section of the below ACT court transcript which was left out of the first copy we were given of the court transcript. See below.

This transcript document confirms much of what we have been asserting. Judge J. Burns "struck out" our appeals and evidence against the OTO child abuse advocates (see their own documents, including those to which we repeatedly refer) with callous and irresponsible disregard, evidently not even bothering to check any of our claims, labeling our written response as simply "embarrassing".

Instead he judged our case merely on the basis of whether or not our claims (which have not been tested by the Judge) cause damage to the reputation and finances of the OTO Inc. and its two executives, Botrill and King. And of course, nobody bothered to address the legitimate and crucial matter of whether the judge or any court officials involved in this process are freemasons.

Following are some noteworthy points revealed in the transcript.

- The judge indicated some concern that a judgment had been entered in the pre-trial even though we filed a written defence, and he said that the appropriate procedure would have been to deal with our written defence. However, he then struck out our defence because he found it "embarrassing". To whom? Us? Hardly. It merely supports the evidence. We're sure it was "embarrassing" to the Brotherhood. After-all, it mostly quoted from the Freemason supported OTO's prime religious text.

- The OTO Inc. solicitor indicated to Judge Burns that only an apology and retraction were sought for the other legal action proceeding against us in the Victorian Civil and Administrative Tribunal. However, since this statement was made, the OTO has indicated that it also seeks damages. "AND THE COMPLAINANTS SEEK: … D An order that the Respondents pay the Complainants an amount the Tribunal thinks fit to compensate the Complainants for loss, damage and injury suffered by reason of the conduct set out in these particulars of complaint. - Mr Botrill, treasurer of the Ordo Templi Orientis, Inc. revealed, " I - I - I represent Australia overseas on diplomatic postings …" with a top-secret security clearance. We are not at all surprised to hear this given that the accumulating evidence consistently points to protection of this blood-thirsty religion by people in high places. Perhaps this is the opportunity to mention the near treetop level fighter jet which shook our concrete house and terrorised the wildlife on its northerly pass over our house and then again on its return trip, distinctly marking our first webpage exposé and reaction to the OTO's initiation of its first legal moves against us. No. Jets don't do that around here, and no, there were no other occasions, although when we first wrote to the National Security Hotline there was that low-flying, black, unmarked military helicopter. Clearly our work is not so embarrassing that they can simply laugh it off.

- Mr King, Chief Executive Officer of the OTO, Inc. revealed that he is a volunteer tutor at Darlington Public School working with disadvantaged children. However they did not tell the judge that what they removed, among other things, was the page named "… righttokill.htm " in which they had presented verses from one of their rituals which asserts that man has a right to write what he will, eat what he will, etc, etc…Man has a right to kill those who would thwart him. And they also removed the erect penis .gif (left) with the 666 beneath it which accompanied the aforementioned verse. And also they removed their copy of their prime religious text which outlines the law of Thelema which, despite what the OTO says, promotes revenge, torture, lust, ritual sacrifice and all those other horrors we have previously outlined.

6th December 2005 - The extra part of the transcript which was sent to us on the 28th November (coincidentally the day of the latest Victorian Civil and Administrative Tribunal hearing involving us) revealed that the OTO National Treasurer described the OTO for the Magistrate thus: "…the objects of the association are the promotion of the religion of Thelema and Thelemic culture as we describe it, you know, sort of artistic endeavours by persons of that religious persuasion."

- OTO Inc. solicitor Moerkerke asserted that we have made no attempts at research. I guess they haven't read our web site, after all. I suppose the judge didn't tell him that we also provided the court with a CD of 2954 files about the OTO. If you haven't seen the following already, please do read our "embarrassing", "there's been no attempts at research" response to the court, as well as this "Compassion is the Vice of Kings - Mark 2" article and this letter we wrote to Premier Bracks, the Equal Opportunity Commission of Victoria and the Attorney General of Victoria for starters. All are already linked in above section as well.

- They falsely asserted that we alleged that several murders were going to take place at the OTO AGM. We said they "may" take place, judging by the OTO's own material which already exists on the internet.

- They refer to a presentation we apparently made which they interpreted as a veiled threat. For the record. All of our presentations have been for the purpose of exposing the criminality of this situation and seeking humane rectification thereof. Although we have certainly expressed views that the OTO are in (self- induced) strife because of their own activities and may face public retribution, and because we do expect their will be repercussions due to their own actions, we never threatened them with any inhumane retribution as they suggest, nor do we condone such acts. We do however, sincerely urge them to finally comprehend the grave harm, both social and spiritual, they do to themselves as well as others as they continue to pursue this dangerous course.

We have received from your office, dated 28th November 2005, a transcript and an audio tape of the court session no. 50689 of 2005 at 11.23 AM, Tuesday, 28th June 2005, as requested. However there are discrepancies between the two. The most outstanding discrepancy we have noticed is in the case number noted on the last page. In the audio recording the number is clearly 50689, as you would expect, but in the transcript it is noted as 57789. Please explain how this came to be.

A further point for which we require explanation concerns the missing section. We are rather puzzled that following our request to your transcript clerk for the complete transcript (having first received an incomplete transcript by email on 7th November), we received this current version of the transcript which contained a section not on the audio tape.

Also, according to that transcript there is still a section missing. It reads,

Please can you explain why there was a break at that point or why that section of the hearing has not been recorded?

Our third point concerns the transcriber's error in recording the word "truth" as "proof". Although the words are similar sounding the word "truth" can be distinctly discerned on the audio tape. Also, we have noticed that when his Honour says, "We can't give you any more than you asked for." it was transcribed as "Don't you mean more than you've asked for?"

Although these latter points may not be hugely significant in legal terms it is clearly important to note the inaccuracies considering the Ordo Templi Orientis members have indicated their intention to launch further proceedings against us which will, no doubt, be based on this extraordinary hearing of the 28th of June (in which our defence was struck out as "embarrassing").

Thank you for your attention to this matter and we look forward to receiving a correction from your office of the above points as well as an explanation for the discrepancies. Considering that legal action, seeking damages, has also been taken against us by the Ordo Templi Orientis through the Victorian Civil and Administrative Tribunal (last directions hearing the 28th November 2005) you will appreciate the need to clear these matters up.

We will forward the remaining amount owing for the transcript and tape on receipt of the corrected and complete transcript.

Principle

A supply of a religious service is GST-free if it is a supply of a service that:

is supplied by a Australian Charities and Not-for-profits Commission (ACNC) registered religious institution, and
is integral to the practice of that religion.

The courts have determined that, for a body to be regarded as a religious institution:

its objects and activities must reflect its character as a body instituted for the promotion of some religious object, and
the beliefs and practices of the members of that body must constitute a religion.

The two most important factors for determining whether a particular set of beliefs and practices constitute a religion are:

belief in a supernatural being, thing or principle, and
acceptance of canons of conduct which give effect to that belief, but which do not offend against the ordinary laws.

Religious institution is not confined to the major religions.

Some examples of a religious service would include, worship, Sunday School, a wedding, funeral or baptism service, religious retreats, bible study groups etc.

The Vos report considered this issue and stated that 'where the services were purely religious and there is no commercial equivalent then it was appropriate for this to be GST-free'.

The following are examples of services that have a commercial equivalent and thus are not GST-free, provision of administrative and financial services, engagement of a minister of religion, the civil or secular elements of religious services etc. Civil or secular elements of a service would include, flowers, music, reimbursement of travel expenses, accommodation and food at a religious retreat, library loan or hire and items for private use in devotion.

Donations and offerings would not be subject to GST as the donation or offering is not payment in return for the supply of a good or a service.

Australian OTO Legal News: December 2007 Press Release

Two Australian residents who were found to have religiously vilified the OTO and its members in Australia have been sentenced to nine months imprisonment for contempt of court after failing to comply with orders issued by the Victorian and Civil Administrative Tribunal (VCAT) to remove offensive materials from their US hosted website.

Vivienne Legg and Dyson Devine had posted a document authored by Reina Michaelson, a child psychologist, in which she made comment that an abusive network operating in Victoria, in which children were sexually abused and killed in a scenario of satanic ritual abuse, appeared to be the OTO.

The OTO acted to defend itself, its members and Thelema against this vile and unsubstantiated slur.

OTO officers Steve King, David Bottrill and Brent Gray appeared as litigants on behalf of the OTO and successfully sued Legg and Devine for defamation, and also filed complaints of religious vilification against them and Michaelson, whose document was also posted on her organisation's website.

In a VCAT case settled last year Michaelson admitted she had not produced any proof that any OTO members were involved in such practices and acknowledged the offence caused by the release of the document. The settlement is located at: otoaustralia.org.au/OTO_final_terms.pdf.

Michaelson also removed the document from her organisation's former website and published a statement (see bottom of csapp.org.au) on her new website claiming that the document was placed there without her knowledge.

On 27 July 2007 Legg and Devine were found guilty of religious vilification and ordered to remove the offensive materials from their website. They failed to do this and contempt proceedings were initiated.

To ensure their appearance before the Tribunal four police officers from Victoria travelled more than 1500 kilometres to New South Wales where Legg and Devine live, and brought them to Melbourne.

Released on bail overnight with orders to appear the next day, they failed to take the opportunity provided by VCAT to comply with the Tribunal's orders and on the morning of Wednesday 28 November 2007 Judge Harbison found that their contempt was deliberate.

She sentenced Legg and Devine to nine months imprisonment with no minimum period.

Sadly, the internet has become a haven for bigotry, ignorance and hate but on a few occasions the perpetrators of vilification are able to be bought to task for their actions.

We applaud the decision by Judge Harbison to jail Legg and Devine who clearly felt that the due process of law did not apply to them.

The Australian OTO is proud to have been able to defend its members and Thelema against these vile slanders and hope that others benefit from the action it has taken.

A SECRETIVE international society linked to the occult is
using Victoria's religious tolerance laws to sue a Melbourne
anti-child abuse activist.

Ordo Templi Orientis has started a suit against psychologist
Reina Michaelson over internet claims it is a pedophile cult.

Documents submitted to the Victorian Civil and
Administrative Tribunal claim Dr Michaelson wrote an
internet article linking the society to pedophilia, satanic
rituals, and animal and child sacrifices.

Ordo Templi Orientis national officer David Bottrill and
member Brent Gray claim Dr Michaelson has vilified and
misrepresented the society, which has a base in Gardenvale.

"What is contained on the website could incite hatred and
lead to violence against members of the OTO," they said.

Dr Michaelson, who won a Young Australian of the Year award
in 1997 for founding the Child Sexual Abuse Prevention
Program, said she was not the author but could attest to the
article's truth.

"The document . . . that is the subject of the complaint
describes the illegal ritual abuse of a young man," she said
in a letter to the Equal Opportunity Commission, which
referred the society's complaint to the tribunal.

Dr Michaelson, who also runs Bravehearts Victoria, said the
society's text, The Book of the Law, advocated illegal
activities.

"Verses talk of blood rituals using children, eating flesh,
the sacrifice of a child, the killing and torture of others
and uninhibited 'love' without restraint," she said.

"I contend that the beliefs of the OTO are not lawful
religious beliefs."

Dr Michaelson, who is overseas, said she would contest the
claim when she returned in July.

Ordo Templi Orientis, founded in Germany in 1902, does not
actively recruit or advertise.

Members follow the religion of Thelema, as taught by
occultist and mystic Aleister Crowley.

Their Australian website says it is dedicated to securing
the liberty of the individual, taught through a series of
initiation rites.

Mr Bottrill declined to comment on the case.

Ordo Templi Orientis has also filed a religious vilification
claim against NSW man Dyson Devine, alleging the article was

Creepy graffiti bearing the demonic symbols of a satanic sex cult are emerging in Broome, prompting a police investigation.

Broome resident Brian Philp raised the alarm on April 23 when a gate at his property and his car were daubed with shapes and figures associated with religion Ordo Templi Orientis and its founding “prophet” Aleistair Crowley.

The graffiti contained the Eye of Horus — an ancient Egyption symbol adopted by OTO said to represent the demon Horus watching over a future new world order — and 666, the numbers of the devil.

Crowley modelled himself as “the Great Beast 666” and revelled in his infamy as “the wickedest man in the world”.

“I did not know what this represented until someone told me,” Mr Philp said.

“Looking at the way this has been done, I would say it is the work of older people familiar with the cult. I would guess they are in their early 20s and they would have to have knowledge of this sect.”

Mr Philp said the graffiti was sprayed across footpaths, rubbish bins, the entrance to a nearby scout hall and another residential property.

More OTO symbols, including the Eye of Horus and 666, have been painted across a building door on the industrial estate in town and on Frederick Street.

“We have been made aware of the emergence of what could be classed as satanic-based graffiti in Broome,” Senior Sergeant Brendon Barwick said.

“We do not have information that would indicate cult or satanic patterns in Broome and there are limited investigation avenues at this time, pending CCTV footage.”

Snr. Sgt Barwick called on the public for assistance.

“I appeal to anyone with information to contact Broome police or Crime Stoppers immediately,” he said.

Crowley once famously bragged he wanted to be “Satan’s right hand man” and his form of worship involved sadomasochistic sex rituals with men and women, spells which he claimed could raise malevolent gods and the use of hard drugs, including cocaine and heroin.

“While the symbols are used by our order we don’t have ownership of them. Graffiti tends to be the work of bored teenagers and posting graffiti or defacing public property is not something we would condone.”

Melbourne actor Jeremy Kewley, best known for his role in the 1990s ABC television series Janus, has been released on bail after facing court charged with more than 100 child sex offences.

The 54-year-old from Brighton was arrested this morning and charged with 103 counts of indecent acts with a child under 16 and two counts of possessing child pornography.

The child sex offences allegedly occured in 2011. (& before no doubt)

A police summary of the alleged offences read out in court stated images of young boys were found on his computer when he was first arrested in August.

Police have alleged he advertised for young men to take part in screen tests in June and July, and 27 boys applied.

The court heard Kewley allegedly made videos in which he inappropriately touched the boys, kissed them, and simulated sex with them while they with wore tight lycra suits.

The prosecution did not oppose bail and strict conditions were put in place to allay police fears he could reoffend or interfere with witnesses.

He will return to court in March.

Kewley started his acting career in Fred Schepisi’s 1976 film The Devil’s Playground.

He appeared in multiple episodes of hit series Neighbours, Stingers and Blue Heelers, and was also the warm-up act for the AFL Footy Show.
