A contract that gives the artist full rights over his artwork isn't unusual. Typically a company will license the artwork in such a case, so the artist can't just walk away with it all and fuck them over - this is where they screwed up. It's not the fact the guy has full rights so he can keep getting royalties on it, it's the fact they didn't license it from him to begin with.

If he's smart he'd turn around and offer them a license to use his art. They'll refuse, of course, because the actual issue here isn't the artist, it's everyone else on that useless dev team - the art guy is the only one who actually did anything. It's no wonder he's walking away.

You're implying the goal of the artist isn't to ruin the project so he can start it on his name and get all of the shekels for himself.

1. The game started with placeholder assets rather than finished artwork so the actual game framework was finished and genuinely entertaining before the art got added.

2. They licensed the artwork for use in the game, rather than… whatever the fuck it was they actually did in their contract with this guy.

In the case of 1, they could just hire another artist. At $40k per month, they can afford it.
In the case of 2, they'd still have all the art available for the game, and would simply have to hire a new artist for anything new.

Both sides are massive pieces of shit but the artist was the biggest jew in the whole picture.
The other guy was too fucking innocent to give someone so much and expect them to act decently.
