437,000 Deportation Cases Backlogged, Hearings Delayed to 2022

The government's processing of illegal immigrants has broken down as the number of backlogged court cases has grown to a ratio of 1,456 per judge, prompting some courts to schedule deportation cases as far out as February 2022, according to a new Government Accountability Office assessment.
The audit agency tabulated a total of 437,000 pending cases, double what it was in 2006. What's more, the normal wait time for illegals to face a judge has grown from 198 days to 404 days.
But an analysis by the Center for Immigration Studies found that in some of the 58 immigration courts that employ about 300 immigration judges the backlog has become so bad that hearing dates are being set as far out as 2022.
CIS pulled this nugget out of the 153-page GAO report that highlights the backlog issue:
"As of February 2, 2017, half of courts had master calendar hearings scheduled as far as January 2018 or beyond and had individual merits hearings, during which immigration judges generally render case decisions, scheduled as far as June 2018 or beyond. However, the range of hearing dates varied; as of February 2, 2017, one court had master calendar hearings scheduled no further than March 2017 while another court had master calendar hearings scheduled in May 2021, more than 4 years in the future. Similarly, courts varied in the extent to which individual merits hearings were scheduled into the future. As of February 2, 2017, one court had individual hearings scheduled out no further than March 2017 while another court had scheduled individual hearings 5 years into the future, February 2022."

The doubling of pending cases, however, is not the result of more illegals crossing the border, said GAO, according to the CIS analysis. The actual reason: Courts are taking much longer to get through individual cases.
"Incredibly, GAO found, ‘the number of immigration court cases completed annually declined by 31 percent from fiscal year 2006 to fiscal year 2015, from about 287,000 cases completed in fiscal year 2006 to about 199,000 completed in 2015,' even as the number of immigration judges increased by 17 percent over that 10-year period," said CIS fellow and former Immigration and Naturalization Service counsel Andrew R. Arthur.
In his analysis, Arthur suggested that some of the backlog can also be blamed on the judges granting multiple case continuances. He wrote:
"One of the main reasons why IJs are taking more time to complete cases today than they did 10 years ago is an increase in the number of continuances that IJs have granted over that period. As the GAO noted (logically): ‘cases that experience more continuances take longer to complete.' After reviewing 3.7 million continuance records from FY 2006 through FY 2015, GAO concluded that continuances increased by 23 percent from FY 2006 to FY 2015 with ‘the percentage of completed cases which had multiple continuances' also increasing during that period. Most critically, the cases in which the largest number of continuances that GAO identified were issued, those with ‘four or more continuances,' increased from 9 percent of cases completed in FY 2006 to 20 percent of cases completed in FY 2015. Those continuances made an impact, as GAO found: ‘[C]ases that were completed in [FY] 2015 and had no continuances took an average of 175 days to complete. In contrast, cases with four or more continuances took an average of 929 days to complete' that year." Shitskins gotta go.

You could say that about every law. A law firm should try to use those exact laws, if anything, to expose the legal system for the farce that it its.

What in the fuck do you mean court cases. They are illegal invaders, it's legal to just forcibly remove them from the country without a court case.

So let's see. If we go off these 437000 hostile invaders, the numbers surmount to ~4553 Judge-days. All it would need to get it done, would be get it done in 90 days, are 50 judges. A few dozen judges working properly, that's all it takes to 'process' all of them in less than 100 days.

Here's an idea. Demonstrations. Preferably, armed demonstrations. Find out where your local judges in the areas in question live, rally together and demonstrate at their homes. Even without actually doing it, a loud, armed mob is bound to make them seriously reconsider stalling for too long on this.

Actually they do get due process unfortunately to determine if they are in fact illegal. It should be a much simpler process but liberal public pretenders and judges help slow the system down. Speedy triel waivers get signed and the judges allow them to get free room and board until room opens up for the case.

Stall the courts from the bottom while the government at the top curbs the number of immigration judges available, thereby creating a bottleneck from two different angles. And when they have these massive backlogs they get to say "oy vey there's just too many undocumented immigrants to deal with! We better just give them all citizenship to alleviate this headache!"

It's a right that can be waved by the defendant. Often times the defendant will try to push a trial back as far as they can for a variety of strategic reasons.

Part of the problem is that most any decision can be appealed, or a case reopened, when an alien is denied an immigration or citizenship benefit on the initial turn at applying. When the alien's issued a denial letter to a green card application, the letter actually gives them instructions on how to file a motion to reopen. In truth—and this is the central problem—it's an easier legal process than is afforded to natives for most any institutional interaction that one might imagine. If they close the case reopening loophole, and instead maintained that denials on Forms I-485 are final, then many of these cases would fall by the wayside.

Another problem is that anybody in removal (=deportation) proceedings can utter this magic word asylum and suddenly their case is put on hold, and the government is forced to put them on a waiting list to have their entire life story carefully examined by a government employee (usually very well paid) who will dedicate an enormous amount of office resources to evaluating just one immigrant's story. They have to research country conditions, question the applicant extensively, provide an interpreter if needed, provide a written assessment, search database records, &c. With aliens in removal proceedings knowing about claiming asylum, we have to provide this vast apparatus to review their applications. And here's the perk (from the alien's point of view): while your case is awaiting review, you are in protected legal status. So with the long backlog, if you claim asylum, then you're guaranteed a few extra years to remain in the U.S. Enough time to start a family and set down roots. By which time, another (((legal path to immigration))) may open up. Or you start a family, and now you can file a waiver based on a humanitarian need. And don't suppose there aren't scores of pro-bono law firms crafting applications that are likely to be favorably reviewed once your case reaches the immigration courts.

The entire legal system is seriously cucked to the point that it's a henhouse with several wolf-sized doors having luxurious red carpets laid out. Immigration law is very short, very simple. It wouldn't be terribly difficult to overhault it via laying the foundation with a handful of public laws. Refugee, asylum, and diversity visa programs need to be shut down forever. Undo the motherfucking LIFE act, basically a Clinton/Bush-era amnesty for illegals by which people are STILL gaining legal status. End all appeal/ review processes. Place a moratorium on green card issuances. Implement entry/exit tracking. Freeze issuance of all work visas… H visas but also employment based permanent residency visas. A lot of aliens obtain green cards through employment… those should all be revoked, those aliens forced to leave. If the laws were changed to specify that only citizens are allowed to work, then you wouldn't need everify any longer, or work permits, or whatever. If you can't prove citizenship, you can't work. That would be a start… I don't know what to do about the hoardes who've already been naturalized to U.S. citizenship.

The answer is simple then. Ice finds an illegal, they turn them over to the military for processing as an militant invader / spy. Fast track the long drops from a short rope enough times and the run for the border will be epic in scale.

Of course, you'd have to deal with all the scams that would probably occur as a side effect - I can just imagine someone starting a business where they'd go down to the border, fill their truck with Mexicans, smuggle them back into the country and then drive straight to ICE. Or people starting covert Mexican Farms to breed them. But the point is it being public knowledge that ANYONE can catch illegals, turn them in, and get a cash reward. This would not only increase deportations, but have the more important effect of making America feel "unsafe" to sneak into and live illegally.

By far the most important achievement of Trump's presidency has been the drop in illegal border crossings and the record number of self-deportations just from sheer psychology. This trend should be encouraged to continue.
