If the supreme court recognizes that any class of immigrants can be banned for any reason, that BTFOs the implication being made thus far that an intention to ban based on religion is illegal. This 9th circuit court will say they've re-assessed and decided that there is no intention to ban muslims in the EO, and that it is legal, while perpetuating the lie that a muslim ban would be illegal in the first place. They want to be able to interfere with future bans, that may very well be based on religion or even race, so they don't want to overplay their hand right now.

Basically a bunch of judges on the west coast liberal states that hear cases that already have a ruling and decide if they should be overturned or not depending on if they find flaws with the original trial. It would make more strategic sense for them to send over terrorists to recruit, radicalize and train US citizens than to just open up snack bars themselves immediately after they arrive. Additionally, it is less conspicuous because they are indirectly associated with any attacks. By utilizing more covert means and layering their recruitment network, this dissociation could be amplified. For example, a recently-migrated member of ISIS could manage a network of recruiters in the US who directly interact with potential actors. They already have a social media presence, post DIY bomb videos, and encourage lone wolf attacks, so it wouldn't be a stretch to believe that they send people over for more hands-on recruiting.

If this is the case, then any attacks would not be perpetrated by immigrants; consequently, it would be irrelevant to cite the number of attacks executed by immigrants from a given country. However, I have not seen this potential threat vector discussed with respect to the travel ban, nor have I seen any evidence to support this conjecture. Maybe I'm overestimating their capabilities?
