Trump's executive order banning immigration for 90 days is a ruse meant to distract the media and the libshits from the heavily stepped up deportation of illegal immigrants. I think this because DHS, in theory, is allowed to impose any restrictions on issuance of visas that they choose - you don't need an executive order for that. What's to say that Kelly isn't restricting visas to the seven named countries, except he's not doing it by the President's EO, but on his own accord and by his own arbitrary standards? In other words, it's possible that Kelly has already implemented an extreme vetting procedure. He and Trump had plenty of time to come up with it before he was sworn in - I don't think it'd take another 90 days to plan out what they need to do. Trump issued the EO anyway knowing it would cause an absolute shitstorm in the media and among the left, and would be yet another complete distraction from everything happening in the background.

No, common law is fine. Unfortunately, most of the judicial system in the US and the UK probably don't really run under common law any longer. Common law kept everything pretty neat and comfy. The language of laws was supposed to be plain and the whole of a law was supposed to be self-contained. There are other ways that common law courts just worked better, but basically since the 1880s or so since we've had all sorts of administrative and judicial rot seeped into the system, it's gone tits up quick.

That's not actually true. The bill of rights, and the fourteenth amendment in particular, hold that "people" have the rights espoused therein, not just "citizens." Constitutional scholars would argue that because the right to vote and the right to hold elected office are explicitly reserved for "citizens" that "people" is a broadly general term that encompasses anybody physically present within the jurisdiction of the United States.
