It is up to the Justice Department, Attorney General Lynch, to bring charges, and she has already stated she is not going to peruse charges. Which was why Chaffetz, in the last hearing with Cooper, stated that they can't bring charges or act, all they can do is question (and recommend), so there was no reason for everyone to plead the 5th especially when they had immunity. The good thing about all these Congressional hearings is that if Trump becomes president, they already have gathered all the evidence they need for Trump's AG to go after all of them.
