I don't know what definition of "victory" you insist on, but the fact that Upper and Lower Canada did not become new US states and retained their condition of colonial autonomy is really good enough, no matter what they called themselves at the time. The Americans who fought in the Revolutionary War were culturally alien to modern Americans, mostly rabbles of Dissenter Christians who were gripped by fear of a papist plot to Catholicize America via King George - why does the fact that they have a name in common with modern Americans give them any more direct claim to the victory?
