The scientist had a 10 year prison sentence until the emails were released to a FOIA request. The trouble here is not how they were transmitted or stored but that they weren't marked classified.

This only works against Hillary if she is responsible for the security level of these specific emails, especially if she did something to change them. Otherwise it's not helpful because it suggests no one got hold of these emails until our own government was dumb enough to release them.
