The ESRB has always been about parents making informed purchases for their children that article is literally them talking about a voluntary program that is designed to get PARENTS informed about video game purchases .
That changed when console manufacturers and retailers stopped wanting AO titles to be sold with on their platforms and was essentially "soft" censorship in that you could still make an AO game but it wouldn't be accepted anywhere. It got worse when politicians saw it as a free ride to get the "responsible" mom votes and tried repeatedly to get the ESRB to push mandatory shit on M rated game sales but obviously they failed several times. It is currently in a state of moral arbiters deciding that ANY game that would be rated over T should be purged or censored to shit because it "triggers" people.

Well, no, the thing is, there IS an understandable reason for limiting ACCESS to something for children. Heck, the second amendment in america means anyone can get a gun, but that wouldn't be too weird to say kids shouldn't get to play with one without adult supervision.
The age ratings are supposed to protect children, who indeed need that. Porn shouldn't be something we allow kids to watch like whatever else, just like gore or highly "traumatic" films. Realistically there isn't because console manufacturers can control a large portion of their markets now with how licensing agreements to be on the console work. This is a reason PC is a "better" platform but this isn't really a PC V console moment.

The answer is "a group of the person's peers" only to the point that they determine if real, actual harm came to somebody due to the speech and nothing else.
The issue is the ESRB isn't and doesn't have the power to limit what can and can't be sold. They are an advisory board. Instead their name is being used by 3rd parties to limit what can and can't be released and sold. Abolishing the ESRB won't fix this because it'll just get replaced or the facade will drop and you'll begin to see "It's my platform I can choose what I do and don't carry."

As far as I am aware the ESRB itself doesn't control how games access is limited once they receive a rating. Yes It is important to limit children's access to mature content but that is not the scope of the ESRB. The ESRB's job is to make sure guardians have an quick way to make an informed decision about media they may not be aware of. The issue is the ESRB is used as a sword by people who don't like certain content and remove it entirely because "muh ESRB rating" when it has been proven the ESRB is not interested in policing consenting adults and is solely interested in protecting children through making use of their parents.

The 18+ games to children thing, as far as I am aware, is only enforced by retailers. California tried to introduce a law that restricted sales statewide and it was struck down in court over there.
It isn't so much advice more of a "Here is the content in this game, we think the recommended appropriate age is this." included with the rating is also a short description of the content that is, again, only designed to inform guardians of content so they can make an informed decision. There are no laws that are enforced by an ESRB rating.

NISA/Capcom/etc have been using ESRB ratings as a scapegoat for years and I think the only reason people started questioning it was when everybody suddenly lost faith in the industry as a whole to truthfully police itself. If you read any interviews with the ESRB lately they do not force content cuts at all. in the past they give a rating and, if requested, advise content changes that can be made for a specific rating. The problem is companies started precensoring games to conform to ratings that hadn't been given out.

If you quickly read through that all it says is you can't advertise a game with what they consider overtly offensive means (most of which wouldn't be allowed in retail stores anyway due to people considering it obscene or poor taste) and it can't target an audience outside of the ratings (i.e. you can't intentionally run an ad designed to make an M rated game appeal to customers under 17). That doesn't have to do with enforcement of ratings and is more of a "We do not want our image to be associated with sex, drugs, and violence." which is rather sensible considering they are technically supposed to be a family friendly advisory board labelling the appropriateness of content for children.
