From my understanding, with IPs, "you can not profit off an IP you do not have permission for or own." You can not use someone else's work for your own financial gain.

When its all free, its a huge gray area, since you aren't profiting off of it, but someone could say you are by boosting your "name" through it. Also, something the name losing meaning and thus no one can own it, which is another can of worms I don't fully understand. Technically, a company can forbid anyone from doing any fanwork if its free. However, if brought to court, the courts will shrug at them because no money is involved.
