There have actually been cases into this and, I shit you not, because this level of bullshit has been going on for so long, everyone expects trailers to not be 100% indicative of the game. Not enough people care or complain about it and now they can get away with whatever they like.

Because it's not illegal and it's not considered fraud to not tell the truth in advertising. It's harder to prosecute in the US than it is to prosecute in Europe and Australia.

Almost every time you hear about some consumer protection thing being filed against a video game it's almost always in Europe or Australia. Whereas in the US if it did happen it would have to be a civil case and almost nobody gives enough of a fuck about video games to spend thousands of dollars taking a company to court over it.

False advertising is extremely hard to actually prove. It gets into semantic debates in court and hearsay. Almost nobody has enough money to spend the literal years it takes to go through with it.

Not to mention it doesn't actually harm these companies legally or financially. The most is they pay a pittance as a fine. Like there are a few consumer protection acts in the UK related to advertising and literally the only penalty is a fine. Unless they killed someone or something like that, in that case they might have stricter penalties but usually that's not affected to the advertising.

Whereas these companies lose significantly more money due to returns and negative P/R than they would if they were charged with something like this legally.

Additionally courts almost never care about false advertising if it doesn't directly harm someone. Almost all cases that actually go to court relate to things like consumer products that killed someone. With video games a judge would probably think it was a slow day if he was being called to act on a case about manchildren complaining about video games.

Advertising law is shit and assumes the average consumer of media is smart enough to recognize content that's unrepresentative of the final product. There's also a shitty clause where if a product being advertised is technically made of the same parts as the finished product then it's apparently not deceptive - this is why shit like the early Watch_Dogs trailers is allowed because even though it's got better graphical effects, much of it is technically still part of the released game.

As long as they remember to say that the pre-rendered trailer isn't actually gameplay, or that the live-action footage they used is not from within the game or is just an exaggeration, they can practically do whatever they want.

Even if a person wants to sue, they'd have a hell of a time finding a lawyer to help them unless they had a really fucking good case, as well as the ability to squeeze a shitload of damages out of the other guy.

Which is why the last "interesting" thing we had was probably the NVidia class action because they misreported the graphics memory on the cards.

Sony had to offer refunds for the Vita over misleading advertisements. Not sure about Ubisoft and EA, but it mostly relies on the customer reporting it. I think most people get a refund and move on if they're unsatisfied leaving the diehard fans, or people who don't care enough.

Why would the government want to stifle capitalism when they themselves profit off of it? At least in the US, we have just enough regulations so that the government can make max profit off of it without undermining the democratic institution itself (at least in the United States, government interference with the private sector equates to fascism, which is a big no-no.)

There's also that a lot of people just don't care enough to bring attention to it. Hell, even engaging in a legal battle would do more damage to yourself than to these multi-billion dollar companies. When it actually does happen, most companies just reach a settlement or give some hush money.
