A temporary injunction is like a temporary restraining order: you need it fast and the standards are lower because it's an emergency and something bad might happen while you're waiting for the court to give you a full hearing. Congress specifically voted against the act and Obama implemented it anyways. Since congress took no action to try and stop it, they’ve set prescedent that they don’t actually have any authority.
