•Colour depth
•Texture sizes

Could have a minimum for playability eg 15fps.

Would aid awareness over the impact of resolution too. Many people would have wildly different preferences and enjoy different ones at different times/moods.

And something fast paced the next. Or by title. Racing games obviously higher framerate.
System could detect movement of objects and alter settings so the framerate is sufficient to have them move enough for motion blur to handle/move single pixels. Resolution lowered too for the same reason.

They're not illegal since not a scrap of owned code is used in them. That's why some emus which relied on having the console's BIOS dumped and installed tend to be distributed separately from the BIOS - and the BIOS themselves hosted elsewhere on the net.

ROMS are not illegal either, however it is illegal to distribute them, and dumping/ripping them for backup purposes is a bit of a grey area.

I almost think a lot of Devs wouldn't even mind even their last-gen games getting pirated and distributed widely - since they're usually more relevant to newer titles in the works, the sales ship has long since sailed in the most profitable territories and timeframes, and it would give a huge middle finger to resalers like Gamestop which is already basically legalized piracy from the Dev's financial point of view.

The end was especially closer somewhere in the second half of 00s, then at best you could get physical from AAA publishers like EA whose games also had DRM such as secuROM or some kind of other shit like one time activation and you could get CD with digital codes you already mentioned.
