If the judge or prosecutor has any integrity they'll dismiss the charges long before trial. Either one of them could make the decision to dismiss it. This could just be a case of police incompetence or police malice. Or it may not be and the system is trying to railroad him on false charges. Courts don't act quickly and he was just recently arrested. During the discovery process the prosecutor will see the same thing we've seen and he will be aware. Daniel Borden's attorney will find this evidence, possibly more and then make a motion to dismiss. Both the judge and prosecutor will review the evidence and the prosecutor can either accept the motion to dismiss or he can argue for prosecution to continue. Both the judge and the prosecutor will watch the video of Deandre Harris charging in the melee with a club in his hand, hitting someone on the head with a club and if there's more video of him striking anyone they'll see that too. After the judge hears both sides and reviews the evidence he can decide to either dismiss charges or not.
